THANK YOU FOR BOOKING WITH TRAVEL ASSOCIATES AUSTRALIA PTY LTD (TAA)

Please find below our Terms and Conditions for your booking. Once you have read through this information please complete and sign the customer Acceptance form and return this as soon as possible. By continuing to use our services you are taken to have read and accepted these Terms and Conditions until the signed form is received.

TRAVEL DOCUMENTS

It is your responsibility to ensure all bookings exactly match the name and spelling as they appear in your passport. Airlines, cruise companies and ground suppliers may charge a fee for a name correction which will be passed on to you to pay or you may be denied permission to travel. Please ensure your passport is valid for 6 months from the date of return to Australia. Please forward a scanned copy of your passport as soon as possible.

PASSPORTS/VISAS

Photo identification is required for all electronic tickets. Passports and required Visas are compulsory documents for International flights. . A Visa may be required for your destination - we can assist with your application but take no responsibility for any problems, additional expenses, delays or rejections; the ultimate responsibility lies with each traveller to ensure they have full and correct documentation to undertake their journey. Passport/Visa requirements vary from country to country - e.g. passport validity, blank pages requirement, criminal record history etc. Non-disclosure of required information may lead to you being refused entry on arrival in certain countries. In that event, we take no responsibility.

TRAVEL INSURANCE

We strongly recommend travel insurance for your travel and this must be purchased prior to your departure. It is recommended that Travel Insurance be taken out at the time of paying your deposit or as soon as possible. Please ask us for a quote on Travel Insurance if you do not already have one. If you are intending to use the travel insurance provided by your credit card company you acknowledge that Travel Associates Australia Pty Ltd has offered you travel insurance and that you will waive the right to any claim against Travel Associates Australia Pty Ltd in the case where you experience any loss or damage as a result of not taking out adequate travel insurance.

FREQUENT FLYER PROGRAMS

Please advise your frequent flyer details to your Associate so these can be added to your booking. It is your responsibility to ensure that your booking is eligible to earn points and that the supplier will credit you with the applicable points for your booking.

GENERAL TRAVEL ADVICE

For current travel advice it is recommended that passengers regularly consult the DFAT site below to keep abreast of regular updates from the Australian Government regarding the countries you intend to visit. DFAT – www.smartraveller.com.au

HEALTH PRECAUTIONS

Vaccinations may be required in order to enter certain countries. This should be discussed with a medical doctor or you own GP. Failure to have the required vaccinations may result in you being denied entry. Travel Associates Australia will not be held responsible for any costs or loss of trip due to you not sourcing the required entry requirements.

PRICES/ CANCELLATION FEES

Generally all prices quoted are only guaranteed once paid for in full. Payment of a deposit will be required to secure your booking but will not guarantee the price. You will be advised of the deposit amount required. This may be a combination of amounts to cover all aspects of your booking – airlines, suppliers, insurance and agent. This deposit will be non-refundable. Some bookings will require instant full payment in order to secure your reservations. Final payment is generally required six weeks prior to travel however this date may vary and you will be advised when making your booking. Even if paid in full, prices may change by reason of matters outside our control. Cancelled bookings may incur cancellation fees that may be up to one hundred percent of the cost of the booking. Some tickets may be non-refundable or non-transferrable. Changes to reservations may or may not be possible and may incur fees. If we incur a fee for a booking you change or cancel, you are responsible for this cost. Any refund for a cancelled booking will not be paid until the fund are received from the supplier. Any excess baggage charges are your responsibility.

AIRLINES / CRUISE LINES

Airlines/cruise lines are third party providers and impose different terms and conditions to the ones imposed by us. Clients should read their terms and conditions before finalising travel bookings. There are numerous rules and regulations in relation to advance purchase and other discounted airfares which involve substantial cancellation or amendment fees and there may be no refund on cancellations or amendments. It is your responsibility to re-confirm outbound and inbound flights and times. Travel Associates Australia is not responsible for amended flight timings or other changes.

SERVICE PROVIDERS

We act as an agent and sell products on behalf of accommodation, transport and other providers such as airlines, rail, coach and cruise line operators. We are not a travel provider and, whilst we exercise care, we have no control over or liability for the services provided by the third parties. All bookings are subject to the provider’s terms and conditions including conditions of carriage and limits on liability. You should read them before finalizing the transaction for your booking. When requested we can provide the terms and conditions for the suppliers involved in your booking. Our service is to arrange and co-ordinate the service offered by third party service providers. We arrange a contractual relationship between you and the provider. We cannot guarantee the performance of the service providers. Any brochures that are not ours and are supplied by the service providers, we accept no liability for errors in that material. By paying your deposit, you acknowledge you have read and agree to the terms and conditions of the suppliers in your booking.

LIMITATION OF LIABILITY

To the extent permitted by law, we are not liable to you for any loss or damage whatsoever (including consequential loss, additional expenses, injury or inconvenience suffered) arising from or in connection with a force majeure event, the acts or omissions of a third party provider in connection with your travel or suffered or incurred by you during the course of your travel arrangements. To the extent permitted by law and subject to these Terms and Conditions, our maximum aggregate liability to you on any basis in respect of any claim for loss or damage suffered by you as a direct result of our services to you is limited to the booking value paid by you in respect to your travel arrangements. Our liability will also be limited to the extent that any relevant international conventions, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law).  This liability clause is subject to your rights under the Australian Consumer Law and nothing in these Booking Terms and Conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).

PRIVACY

The terms of our Privacy Policy are incorporated into these Booking Terms and Conditions. You acknowledge and agree that we may disclose some or all of your personal information as outlined in our Privacy Policy.

GOVERNING LAW

Should a dispute arise between you and us we will be governed by the laws of Western Australia. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Western Australia, and waive any right that you may have to object to an action being brought in those courts.

FORCE MAJEURE

Force Majeure is an event or effect that can be neither anticipated nor controlled. It is a contractual provision allocating the risk of loss if performance becomes impossible or impracticable, especially as a result of an event that the parties could not have anticipated or controlled. This includes but is not limited to an act of god, peril of the sea, accident of navigation, war (including civil war), sabotage riot, terrorism, insurrection, civil commotion, coup d’état, national emergency, martial law, fire (including wildfire), explosion, lightning, tsunami, cyclone, flood, tornado, hurricane or other major weather event, closed or congested airports or ports, earthquake, landslide, volcanic eruption or other natural catastrophe, epidemic, pandemic, quarantine, outbreaks of infectious disease or any other public health crisis, radiation or radioactive contamination, industrial strike, national strike or other major lack of availability of labour, raw materials or energy beyond the control of the affected party. For the avoidance of doubt, the inability of a party to make a profit or avoid a financial loss, changes in market prices or conditions, or a party’s inability to perform its obligations due to insufficiency of finances does not in itself constitute Force Majeure.

YOUR RESPONSIBILITIES

You warrant that you are over the age of eighteen (18) and have sufficient funds to pay for the travel services. You have read our Terms and Conditions and if booking for third parties have conveyed these Terms and Conditions to them. You have read the Terms and Conditions of any third party service providers and agree to be bound by those. You are responsible for checking the accuracy of all documents provided to you. You are responsible for contacting the airline at least seventy-two (72) hours prior to travel. You warrant and acknowledge that you have accessed the Smartraveller website for any specific enquiries in relation to your intended destination. Passport / visa and other required identification documents are your responsibility.

  • Airline Reservation Fee: International Travel $170 per ticket Domestic & Trans-Tasman Travel $27.50 per sector
  • Itinerary Planning Fee: $165 per person
  • Reservation Deposit: International Travel $200 per person - Domestic Travel $165 per person
  • Reservation Cancellation Fee: International Travel $200 per person - Domestic Travel $165 per person
  • Additional to fees levied by suppliers
  • Amendment Fee: International Travel $50 per person - Domestic Travel $33 per person
  • Applies after bookings confirmed and in addition to fees charged by suppliers
  • Visa Processing Fee: Local (Perth) Consulates $30 per person
  • In addition to consular charges Interstate Consulates $40 per person
  • Frequent Flyer Bookings: International Travel $170 per ticket - Domestic Travel $55 per ticket
  • Credit Card Merchant Fees: Visa, MasterCard 1.5%, American Express 1.98%
  • Cheque Payments: Cheques only accepted when 7 days clearance is given
